Privacy Policy

This privacy notice discloses the privacy practices for Mexican Street Food, LLC. dba Puesto, our website and our restaurants. This Privacy Policy describes what information we collect about you and how we may collect, use and disclose it. By visiting our website and restaurants, you are accepting the practices described in this Privacy Policy. This Privacy Policy is effective as of January 30, 2020.

Information Collection, Use, and Sharing
We are the sole owners of the information we collect. We only have access to/collect information that you voluntarily give us via email, phone or other direct contact from you. We do not sell or rent this information to anyone. 

We use your information to respond to you, regarding the reason you contacted us. We do not share your information with any third party outside of our organization, other than as necessary to fulfill your request, i.e., gift card sales or merchandise orders.

Unless you ask us not to, we may contact you via email in the future to tell you about specials, events or services, or changes to this privacy policy. 

What We Collect
Puesto collects information that you voluntarily provide to us or through third-party web servers or service providers that we utilize. These include:

Personal Information: We only collect Personal Information from you when you voluntarily submit such information in one of our restaurants or our site. We use this information for the specific purpose for which it was provided, such as making a reservation, purchasing a gift card or other merchandise, or booking or attending an event. Such Personal Information may include the following: name, address, date of birth, gender, and contact data (including email address, telephone number, and physical address), and online identifiers like social media handles, if provided.

Visit Information: Including without limitation products purchased, restaurants you have visited or booked reservations at, details about events you have planned or executed at our restaurants or any other information relating to your purchasing or consuming histories or tendencies as it relates to our restaurants, products and services.

Interactions:  Including without limitation your event inquiries, marketing, sales or advertising proposals, feedback and reviews of our restaurants, products and services, or questions and information you provide to our team. You can withdraw from any marketing related emails by clicking any “Unsubscribe” links in the footer of our emails or by contacting us at

Payment Data: Including without limitation your credit card information, billing address or any financial information you provide in connection to your purchase of our products or services, such as events. 

Cookies: To enhance your experience on our websites, we use “cookies” or similar technologies. We may use cookies to personalize your experience, recognize you when you return and enable you to use our third-party applications on our website. Cookies recognize your web browser, but information collected from cookies is not personally identifiable. Some web browsers provide settings that allow you to control or reject cookies or to alert you when a cookie is placed on your computer, tablet or mobile device. Although you are not required to accept cookies, if you block or reject them, certain features of our site will be disabled and you will limit the functionality we can provide when you visit our site.

Video Surveillance:  As a security measure and to ensure the safety of our properties, we use video surveillance technology at our restaurants. This collection is subject to applicable privacy laws and may be shared only in limited circumstances.

Our site is not designed for, nor is it directed to, children. We do not offer any services via this site to children under the age of 13, nor do we knowingly request or collect information about children under the age of 13. If we learn that someone under 13 has provided personal information through our site or otherwise, we will use reasonable efforts to remove that information from our database.

This website contains links to other sites, such as Facebook, OpenTable and others. Please be aware that we are not responsible for the content or privacy practices of such other sites. We encourage users to be aware when they leave our site and to read the privacy statements of any other site that collects personally identifiable information.

California Privacy Rights
While California law applies only to California residents, we believe everyone should have the same privacy rights regardless of where you live. So our privacy tools are available to all of our users.

The California Consumer Privacy Act of 2018 (the “CCPA”) provides California residents with rights to receive certain disclosures regarding the collection, use, and sharing of “Personal Information,” as well as rights to access, delete, and restrict the sale of Personal Information that Puesto may collect about our customers or visitors to the Site, effective January 1, 2020. The CCPA defines “Personal Information” as “information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.” Personal Information includes information that Puesto describes above under “What We Collect.” It does not include deidentified or aggregated consumer information.

If you are a California resident, you have a right not to receive discriminatory treatment for the exercise of the privacy rights conferred by the CCPA.

Collection and Use of Personal Information
Puesto collects various categories of Personal Information when you use the Site, including identifiers, commercial information, internet or other electronic network or device activity information. A more detailed description of the information that Puesto has collected and the categories of sources from which Puesto collects that information are provided above. Also provided above is a statement about how Puesto uses your Personal Information, the categories of third parties with whom we share Personal Information, and what information is shared under different circumstances and for specific business purposes. In addition, Puesto generates inferences internally to help us understand how users interact with the Site, to develop and offer products and information, and to improve what we offer to users. Puesto will not collect additional categories of personal information or use the Personal Information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

Disclosures to Third Parties for a Business Purpose
We limit disclosures of Personal Information for business purposes as described above.

Sale of Personal Information and Right to Opt Out
Puesto does not sell your Personal Information to third parties and will not do so in the future without providing you with notice and an opportunity to opt-out of such sale as required by law. Similarly, we do not offer financial incentives associated with our collection, use, or disclosure of your Personal Information. Our Site, like most others, uses cookies. To learn more about our use of cookies and your choices, see above. Please note that your right to opt out does not apply to our sharing of data with service providers, with whom we work and who are required to use the data only on our behalf.

Right to Know and Right to Request Deletion of Personal Information
As of January 1, 2020, California residents have the right to request that we disclose what Personal Information we collect, use, and sell, as well as the right to request that we delete certain Personal Information that we have collected from you. Once we receive and confirm your verifiable request, we will disclose to you, based on the nature of your request: the categories of Personal Information we have collected about you; the categories of sources for the Personal Information we collected about you; our business or commercial purpose for collecting that information; the categories of third parties with whom we share that information; and/or, at your request, the specific pieces of Personal Information we collected about you.

Note that we may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.

2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

3. Debug products to identify and repair errors that impair existing intended functionality.

4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.

5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).

6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.

7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.

8. Comply with a legal obligation.

9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

If we deny your request, we will provide you with an explanation of our reason(s) for doing so.

“Shine the Light”
Separate and apart from the CCPA, California’s Shine the Light law gives California residents the right to ask companies what personal information they share with third parties for those third parties’ direct marketing purposes. Puesto does not disclose your personal information to third parties for the purpose of directly marketing their goods or services to you; however, if you would still like to make such a request or if you have questions, please contact us.
